Hope for Homeowners?

The 8th Circuit federal courts recently dealt with a very important case for anyone who is trying to save their house from a foreclosure. The Fissette case, as it is know, deals with whether or not homeowners in Minnesota can get rid of their 2nd mortgages sometimes when the file for bankruptcy. The verdict? Maybe. The court punted the decision to the lower courts to have some additional issues figure out. In the mean time, bankruptcy attorneys like myself will continue to try and get rid of 2nd mortgage wherever we can, and hope that we hear good news from the courts in the future. Bankruptcy filings fell again in August

According to Buffalo News bankruptcy filings feel again this August. While Minnesota is NOT New York, this trends can be seen in our state as well. "New bankruptcy cases fell 10.6 percent from a year earlier in the Buffalo and Rochester courts, to 538 filings from 602 in August 2011, according to new statistics from the U.S. Bankruptcy Court for the Western District of New York. That includes a 7.7 percent decline in Buffalo, to 359 from 389, and a 16 percent drop in Rochester, to 179 from 213."

According to the Boston Herald, bankruptcies are down this year, by quite a bit. The newspaper reported that "Nationwide bankruptcy filings fell sharply in the first six months of 2012 to 627,000, compared to 725,000 for the same period last year, according to a report issued today by" This continues a trend we are seeing. It would seem as though many of the people who could afford to file for bankruptcy, have already done so. Those who can't afford to file, are still treading water trying to pay their bills.
